Any fruit that doesn't transform the user to an animal/buddha/human/whatever or to an intangible element (except ice, and maybe sand) is a paramecia.
It's pretty simple really. Zoan = animals, Logia = (forces of) nature and Paramecia = everything else. Logia and Zoan always change the body, into a "force of nature" or an animal; Paramecia can do it as well but doesn't have to.

It's a paramecia because Whitebeard was a quake-man, not an earthquake man, due to the "Tremor Tremor fruit", in translation… so it doesn't count as a force of nature. Oda stated this in an SBS, can't remember which volume, but I'm sure someone else around here knows.
Pretty sure that Oda said that WB is most technically a "vibration human". He can create vibrations, that's the power of the fruit, just the fruit is named the Quake fruit (names don't always coincide perfectly with functions, see Enel's "Rumble" fruit) and he's colloquially referred to as a quakeman (it's comparable to Blackbeard's "darkness" which is in fact gravity). However the similarity to a "force of nature" could be why Oda said that he's a Paramecia who is no less powerful than a Logia. And the forces of nature thing is his words, too. It's something like "… (Logia types) give you control over the forces of nature...". The word Logia, if I'm not mistaken, also means nature-something. Both are from SBS… not sure of the volumes, but I'm confident it's there (unless the translations I read were messed up). So yeah. Nature is definitely specifically associated with Logia types.

Magellan was still able to be physically hit even when covered in Poison - however you would be poisoned from hitting him. If Magellan had been Logia it would have been like Caribou who could absorb a cannon ball through him. But his actions were incredibly Logia like so it did confuse a few till Luffy was wailing on him.

There's probably talk of this in the chapter discussion, but a thought on Brook's new ability, which until given an official name I will refer to as Soul Scout.
Up until now Brook's fruit power of Yomi Yomi has been simply Revival. He died, activating the fruit's power and rebonding the soul to his body and leaving him only with the Devil Fruit Weakness.
Brook's unique circumstances of being Just Bones allows extra eccentricities, i.e. running on water and increased jumping.
Soul Scout is another ability I think Brook is able to due purely because of his unique circumstance on account of being alive in a body that couldn't possibly live. So as long as he puts enough focus behind it, he can separate his Soul from his Body, and later rebond it back to his Bones.
As to whether or not he could rebond his soul if it were ripped from his body i.e. the proposed effect of Brook vs Blackbeard or if he were to be killed remains to be seen, which also brings up the question to how Brook could be killed and if he is, in fact, immortal due to this.

Devil fruits, to me, are implied to be actual 'souls', of a sort. When a user dies, the power is freed- presumably it would naturally return to the tree where the fruit holding the power originated, and it ONLY does that when the user dies. No two people exist who have the exact same power. Blackbeard's ability, to 'siphon' the devil fruit power itself from a dying/dead user seems to suggest that the power itself is indeed a 'living' (at least functioning) and ultimately isolatable essence. And 'living' can even be in a more literal sense, as seen for example with Funkfreed, Spandam's sword-turned-elephant. Although, they can only be called a soul to a certain degree, since the user exhibits no effects that would imply troubles that come with two souls sharing a body. The power seems to fuse with the host soul until death, whereupon it is reincarnated within another fruit from the tree (Exception being Brook's power, explicitly stated, since it allows him to come back to life. The fact that the power was still bound to his soul made it possible for him to float around looking for his body).
Of course, if that's indeed the case, the question of how these souls originated comes next… and that's where i have nothing. Well, we have had hints of people knowing what Devil Fruits 'really are' (Obviously implying that they're more than just fruits that grant amazing powers when eaten), but nothing has popped up which allows me to form a more comprehensive picture; to confirm or joss my theory. There isn't really any evidence to support the theory that the powers were created by humans (except maybe the fact that some fruits grant powers centric to human culture, like Apoo's allowing him to turn himself into instruments), but I believe that they definitely weren't a feature of the One Piece world to begin with. My first suspicions lay with our mysterious void century. If the government knows the truth about both Devil Fruits and the void century, but will divulge neither (Vegapunk may know the truth about devil fruits, but it seems to be classified info otherwise), the possibility of them being connected seems at least plausible.
The theories about how they could have been created all seem rather silly in my head. Deals with the devil to get powers? Actual devil's souls that are trapped? People casting spells to create them? All seem pretty improbable.

I've been wondering if they count every Tori Tori no Mi model as one, because if Marco's fruit is considered as Tori Tori (mythical of course), it already makes two of them. And I don't think that falcon and phoenix would be the only known bird DFs, so there should be easily more than five different flying DFs. But I don't know, maybe they just are that rare.

I think that the bw agent was referring only to birds zoan fruits. Besides, I don't think that Shiki's power works with living beings, because he nerver had used in that way against any enemies, He can fly using his power on his swords.

Yeah, indeed. And then there is the whole Logia debate, Smoker and Crocodile can "fly" and even float in the air. I remember Smoker doing some sick tricks during Marinefold.

Logias don't count as far as flying DFs are concerned, since they really can just sorta propel themselves upwards and float. And Shiki's was just levitation, he just happened to have things he could levitate on his feet. So far it's just Pell, Marco, and Lafitte.
I wouldn't expect it to count every tori tori no mi as only one, since it was saying fruits, and each individual model is an individual fruit.

I would just like to see more DFs that aren't completely off the wall. A lot of the supernovas had really bizare powers that I'd need explained. Capone's seemed like a variation on Wapol's but took it to a really odd level.
