Well as I said I´m still convinced that DF´s don´t work on merman, but lets for one moment try to see it from the other way:
Let´s just assume that Jinbei is the strongest merman in the OP world. Ok, normal merman are 10 times stronger then normal people so I don´t want even to start assuming as how strong Jinbei must be.
The fact is that Jinbei must be a good fighter, otherwise he wouldn´t be a Shichibukai Pirate.
Well, the way how I see it strong fighters work out to erase or decrease their own weaknesses. Let´s just assume that Jinbei would have somewhat of Zoro´s fighter´s attitude, then I COULD picture him as a guy who goes into water and starts to work out to move there. Probably he couldn´t move a finger for a very long time, but as a merman he wouldn´t suffocate either. But merman are also ten times stronger then normal humans so this could be enough for him to at least walk or at least eat down there.
If that would be true he could mentally and later on physically work out on how to move under such circumstances. I actually picture this whole idea somehow similar to DragonBallZ when Goku etc. work out with 100 times higher gravity. Im not saying that it is an easy way, but the merman body could give Jinbei the qualification to learn not to be a hammer under water.
But anyways, I still think that for a race that labels itself as superior other´s race´s rules don´t apply.
And just one more thing. Just because it has been said that DF users can´t swim it doesn´t mean that it will stay like that for ever. It often happened in so much stories that limits for character´s are established, but in the end there´s always that one superior character that breaks the limits. If Jinbei would have eaten a Devil Fruit if he would be able to move under water then he would just be another example for that phenomenon.
