Well ID level 6 for me was always place where marines put people that if set free would be danger to some country as whole, or simply very strong individuals among pirates and not only- example was Shiryu.
Or you want to tell me that he was one of worst criminals in history because he was killing criminals in ID? I dont get you now. Level that they put you in ID depends on how strong you are and/or how strongly you can affect innocent people.
For example Iva was put in level 5 not being as big of a threat to simple folks as for example Crocodile.
Also if level 6 would not be filled with strongest criminals then would Blackbeard search there for crewmates? I dont think so. At worst case scenario Diamante would land in level 5, my bet is still on level 6 though.
Robin is very exceptional and kind of bad. Also they would want to execute her and not put her to prison- dont you remember entire Enies Lobby arc? Because it looks like you forgotten about it giving that example.
As for fodder word- I used it when somebody is absolutely outmatched by adversary. Maybe you grown tired of that word because of big part of this arc and comments of people on Rebbeca Not my fault you are so picky on it.
To finish up here I just want to add that you assume that Burgess didnt had haki because he is CQC fighter and thrown a house at Ace. Burgess was no match for Sabo as it looks now and as he is even now he would be no match for Ace as he was when fighting Blackbeard. Ace was fairly stronger than Luffy before getting captured, most probably Luffy catched up to him and Sabo now.
There are obvious exceptions to the rule, like Shiryu, Jinbei or Ace.
However, since Diamante doesn't have some special factor like being a shichibukai, being a former member of the ID staff or having a yonko coming to save him…he wouldn't make the cut.
The other level 6 prisoners were people that were essentially erased from history because of their terrible crimes.
Diamante does not fit that bill, hell, doesn't even come close to that bill.
So yeah, there's not a chance he'd be sent to level 6.

Burgess and Sabo seemed to be having a fairly even fight, Sabo wasn't tanking his moves or one shotting him. Whether Sabo was being completely serious is another story, but then again, Burgess seemed to be having fun as well till the ring exploded lol.
