No one also holds the rights to the name Cobra since cobra is a snake and therefore public domain.

Hasbro owns the right to G.I. Joe. They just give 4kids permission to create a cartoon of their products
Its not a matter of kids being confused over the use of Cobra, its people identifying the character name with someone else.
This copyright and trademark thing is not an exact science. It has its loopholes.
