Funi Files Lawsuit

@Badass:
How so?
Well I'm sure that if it were that easy it would've happened by now. I think it was easier to start a simulchapter release of "Rin-Ne" since it began with the first chapter. There really isn't really much of an infrastructure for simultaneous manga releases yet, and I think it would be more difficult for manga series that are already so far in. But yea, it probably all comes down to rights issues and planning for how to make it profitable and such. It probably could be done down the line but I think it'll be quite a process. Maybe it's already being worked on, who knows.
-
I'm betting the details of the contract between Viz & Shogakukan makes it a bit difficult (seeing as they were drawn a while ago and might not have foreseen the importance of online content).
-
That's like buying 50 candy bars at your local convenience store, and then walking in and say "I bought so many in the past, that I deserve to just take this one", and trying to walk out with one without paying.
There's a physical product being produced there that suddenly the producers are no longer getting repaid for in terms of material and shipping, and the store owners aren't getting back either.
It's NOT the same.
Is it stealing if you go t a library and sit down for 6 hours and read part of a book there? Or if you browse through a book store?
I get a monthly bus pass for 30 dollars. That's cheaper than paying for the fare to and from work every day, which would come out to be 40 dollars. Am I stealing those extra rides? Or am I paying for what I get by being a constant consumer and getting the new one every one as soon as its available?
@Zach:
The best solution on the manga end is a simulchapter release. It's ridiculous that it doesn't exist as it isn't such an incredible concept. I can't blame Americans the same way for looking at scanlations because it isn't the same situation. It's comparing apples and apples that you can't get for a year and a half.
Rin_ne gets a simultaneous release, on the official Viz site, translated. (And they do it for free!)
Testing the waters with Takehashi, but yes, its clear it CAN be done and they're WILLING to do it.
The minute Viz starts simul-releasing OP, (at a reasonable price, I don't even insist on it being free.) I stop with the scanlations forever.
-
I will continue to read the scanlations.
It isn't like OP Manga is struggling. It is breaking records.
I purchase the Funi DVDs, and they are struggling to an extent. I think this is sort of like the going in the library and reading a book, but never buying it. -
not reading through everything, cause i gotta go to work soon, but I think I remember back in the day, if you owned the VHS it was legal to make copies, as long as you weren't selling them for money. It's your VHS you can do with it what you want. coarse, things could have changed too, or I could just be remembering wrong.

@Badass:
Because he's basically been repeating the same thing over and over again no matter how many times people say exactly what I did in my post.
That is because people have been trying to explain how their stealing is different from other peoples stealing.
I can't speak for anyone else, but this guy keeps coming down on me for doing something I Repetedly try to to tell him I am NOT doing.
No you just tried to explain how your stealing is different because you like Funimation. I don't understand why you think 12 year old kids bitching about how they might get sued downloading are lighting boxes of starving boxes of orphans on fire on church steps then running over them with steamroller in their spare time.
My ONLY problem is with the people who are fucking villainizing FUNimation for trying to do something about it like these people are god damned entitled to have those illegal anime episodes.
See this your problem, you are letting people whom we all acknowledge are stupid to get you upset. The correct response is "Wow, those 12 year old crotch dropping are stupid" not a bunch of FFFFFFFFFFF ZOMG THEY ARE KILLING THE INDUSTRIES I HATES THEMS!!!!!!1111!!!!one!!!eleventy!!
As I said before, Funi most likely want to go after the fansubs and rip groups but most likely they can't because those people and/or servers are outside the United States. Funimation only has power within America and anybody outside of the country are 'safe'. There are ways for Funi to get those people but those ways take a lot of work and it really depends if the other country wishes to help out. So instead Funi is doing what they can which in this case involves filing a lawsuit to people who upload/distribute the fansub.
When I first started with Giant Japanese Conglomerate in 2002 my first job was re-translating the Jinglish documents so that they made sense and writing up and sending out C & D letters to people who were slapping our logo on their products. Usually in order to proceed with a case you want an actual quantifiable concrete example of how they affect sales by stealing your IP. In this case I can see them saying that they were robbed of X number of clicks for each user that downloaded and maybe they were distributing. That is a bit more nebulous than our legal team would go with, they would go with they are giving out our IP and effects sales of DVDs. That is were my disconnect is with their lawsuit. A C&D to the producer makes more sense to me even if they are overseas Funi has partner companies and distributors of their product that can act in their stead. That would actually be less work and get better results IMO.
@dirt:
shut up, kuminator
kingidiot was implying that she felt entitled to our manga fix
simple as that
No, I simply pointed out the hypocrisy of getting angry at people doing the exact same thing you are doing.
-
They are killing the industry.
You're an idiot.
shut up

@dirt:
They are killing the industry.
Obviously over saturating the market, business models drawn up by a lobotomized chimpanzee, economic conditions, failing to read their customer base and not seeing the writing on the wall is all the fault of fansubbers.

So eloquent and erudite. I would suggest you join the parliamentary debate society I am certain they would laud your eloquence.

Look, I'm not, nor was I ever, trying to sit here and tell people that they should stop doing what they're doing, or even that it's really morally wrong.
Ah, okay; then I apologize and hope I didn't cause any offense.
-
Kingloser can't read.
Stop responding to him already.
-
@RobbyBevard:
big post
Going to copypasta what I said earlier.
Well, if you check the scanlation first, that's stealing- there's no two ways about it.
The truth of the matter is you can't justify reading scanlations 'ahead of time' from a legal standpoint (note: LEGAL standpoint, not moral), which is the kicker if you're subscribed to the releases and actually paying, but I guess it has to be accepted.
To clarify: technically speaking, reading stuff ahead of time- outside of the allowances of your subscription- is illegal. Essentially, you're reading something that hasn't even been released yet. The subscription only covers it at a later date- it isn't effective right there and then.
It's not worth getting your knickers in a twist about. If it's illegal, it's illegal. If you have a good reason and still support the series, then so what? You're not one of the freeloaders who expect everything delivered to them free of charge.
-
Purchasing chapters, or anime box sets, later, does make amends, morally, as far as I am concerned. After all, I said a long time ago that I would be more than willing to buy any decently-made version of One Piece once they came out.
However, I have to agree with Demon Rin, this is not a good legal argument. Any number of things could happen that would keep you from purchasing them at a later date. You could die, you could lose your job and not have money for it, the company could lose it's license to distribute, or many other problems could arise. If anything at all like that happens, how exactly will you be able to pay Toei and Oda then for the product you, and I, claim to have borrowed years ago?
It is still illegal. The only question is whether or not you feel comfortable with it, and where you draw your own lines.
For the record, I don't like what Funimation is doing. Going after a Yibis means that they are going after someone for providing something that is already provided for free. It just seems a bit odd to me, but I'll continue to shell out money for their DVD releases.

IIRC, people watching stuff on their website is money going into their pockets, even if the one viewing does so for free. I don't quite understand how it works (some video-hosting sites do that), but that'll be it. They're losing out because of yibis providing them absolutely for free, what with that sub contributing neither the Japanese or the American market. Since they're available for download, there's no monetary support through means of the website.

They're not going after Yibis.
They're going after 1337 people who downloaded one of Yibis' torrents.

One Piece is not in a library.
If you paid for Volume 22 you paid for Chapters 196-205.
You now have legal rights to read those chapters, in the book you purchased.
Even though you own that book, downloading the chapter is still illegal. If they tried to do something to you, their argument would be "If you bought it, why didn't you just read the one you own?"But besides that, you now own Chapters 196-205. Having made that purchase, or even planning to buy Volume 23, even putting volume 23 on preorder does not entitle you to download Chapter 206. It's Still Illegal.
Personally? I think you're morally in the clear, because I do the same thing. I buy all the Tankobon, so I read chapters in advance, it's my own moral policy on One Piece.
It's Still Illegal. In the eyes of the Law, if nobody else.
Again, I got pinched and had my internet turned off for downloading a movie I own. On Blu-ray no less! I paid a premium Price for the Blu-ray special edition of the Dark Knight. When I wanted an SD version to watch on my computer, I downloaded it, it was Illegal, so I got pinched and my internet was turned off.
That's how it works.

Hmmm…....
Downloading illegal anime episodes is in NO way any less or more illegal than downloading manga chapters.
The same line repeated in a REALLY Big fontOk, so you aren't actually reading my posts then, got it, glad we cleared that up.
And considering he just did it again right in front of your eyes, I hope this shows some people why I was getting upset. I was upset at this guy. So, we cool now Flux?
-
Well now it seems that all but one defendant are dropped from the lawsuit.
-
Well now it seems that all but one defendant will be dropped from the lawsuit.
It's phrased a little oddly, all the judge said is that the plaintiff couldn't enjoin the defendants. FUNimation may still sue the other 1,336, but apparently FUNi's lawyer's "Swarm Theory" didn't really seem too plausible to the court. Not entirely surprising. The big question: is it worth it for FUNimation to sue 1,337 people individually (at $350 a piece)? Probably not.
-
Yeah. suing 1 person doesn't have the same ring as suing 1337 people. Either Funi knew this from the beginning or they are planning to go into the 'rainy day' account to at least get another 99 people.
-
they are going after anime crazy site too
-
well that kinda proves they will continue one piece. i mean why go through all this for a show u gonna drop. Am I right
-
Oh, hey no! Not Animecrazy! I can't watch the official stream xO Then I'll have to go to more than one site to watch anime..
-
This has to prove they will continue One Piece. I am wondering if they thought that shutting down these sites will boost DVD sales?
-
Or to show the Japanese that they are willing to take legal action to protect their series in North America.
-
Well this is kinda old news but it hasn't been mention here so… http://www.animenewsnetwork.com/news/2011-03-24/funimation-dismisses-its-one-piece-bittorrent-lawsuit
I can already hear the sighs of relief and disappointment. -
I kind of sigh a one of disappointment. Hoping that they go though with it since it would be a laugh but oh well. The idea was good while it lasted. haha
-
I'm getting more and more concerned that things like this are more signs of their increasing lack of support for One Piece.
-
I'm getting more and more concerned that things like this are more signs of their increasing lack of support for One Piece.
They could only sue one person. It's not like it would be worth the effort, money, or time. It also wouldn't deter any future torrent downloaders since they could just go "meh. I've only got a 1/1337 chance of getting sued anyway. There are also ways of getting around it. I still think this was just a publicity stunt myself. I would also think that all of the new merchandise would show that One Piece'll be sticking around.
-
What merchandise are you talking about? Funimation doesn't have their own shop, and all I see on RightStuf is import figures and the same tired keychains and wallscrolls.
-

Then that might be it. I'm not well knowledged in the merchandise area.
But yeah. My point still stands that there was no point in suing anyone once they only had the choice to sue one person.
-
What merchandise are you talking about? Funimation doesn't have their own shop, and all I see on RightStuf is import figures and the same tired keychains and wallscrolls.
Rightstuf IS Funimation's shop. And new merchandise has been coming out every month or so. Like the Bartholomew Kuma Hat and Laboon Plushies that are coming out soon.
-

Also it would seem like the best place to find merchandise will be at conventions. This past convention I saw One Piece shirts with the Funi's One Piece logo on it along with the Luffy's Straw Hats being sold.
-
A lot of con merchandise is Japanese imports (which is fine), but yes, Funimation is getting more merchandise out the door, including stuff with Water 7 characters (such as a deck of playing cards that feature Kokoro's family, CP9, the Thousand Sunny and Sogeking, and Galley La on its aces and Franky on all of the 3 cards). I've also got a shirt with the Straw Hats in Water 7 outfits plus Franky in the background.
I think if ANYTHING is indicitive of the series moving forward, though, it's the Kuma hat. Not counting the simulcast, the only episode Funimation has featuring Kuma is the meeting at Mariejoa that originally introduced him and Doflamingo, and at that point we really didn't know much about him at all. Why release a piece of merchandise prominently featuring a character minor (at this stage of the game in the DVD release) unless they planned on getting to AT LEAST Thriller Bark?
On the other side of the coin if they're basing that of simulcast response that means the simulcast is doing well and if the simulcast is going well that's a good sign that they'll continue with the DVDs, too.
Look, the lack of announcement has me going "ehhh . . . nervous" a little bit, too, but I'm seeing more positive signs than bad signs because really, the only bad sign is that an announcement hasn't happened YET and there are a lot of conventions coming up - I won't even be that worried if we don't hear anything SakuraCon/AnimeBoston weekend because there will be another con in a couple more weekends.
-
Don't you mean "3 aces" ?
-
@No:
Don't you mean "3 aces" ?
Nope. Like a normal deck of cards there are 4 of each card, one for each suit. Franky is on the 3 of clubs, 3 of hearts, 3 of spades, and 3 of diamonds in different poses (the 3 of hearts is him in a maroon t-shirt and a yellow scarf/towel over his shoulder, presumably from after Enies Lobby since that matches with the theme of the rest of the suit). Kokoro's family is the Ace of Diamonds, CP9 is the Ace of Clubs, Sogeking and the Sunny are the Ace of Hearts, and Galley La is the Ace of Spades.
Either way new merchandise means good things for One Piece in America as a whole.

The Dub is streaming only for residents of United States, which is preety much a small part of the english speaking world-wide community.
For the rest of us, there is fansubs, Bittorrent and video sharing sites !Anyway, the dub probaby just washes away half the blood and bruises, disfigures half the jokes, bleeps half the words, and increases the price tag for their work, calling it "Censorship". (yes, the grapes are probably sour.)
