Problem is it's a religious term and that's one thing iI'm prety sure can't be infriged .
Also the show's title , as it is , was copyrighted too , so it did not infridge his exisiting copyright .
You can't copyright a word, but you CAN copyright a TITLE. Its the context.
You could also make Avatar the Cartoon, which is a different copyright. Or Avatar the Comic book, which is a different copyright.
Or Avatar the Novel. Different copyright. But if any of them feature blue cat people, there's a problem.
You can also throw the creator's name into the title to help differentiate.
Plus, plain old audience confusion to avoid.

Because he wrote it back then. It was unfilmable 15 year ago, he was waiting for the tech to catch up.
But it would have been fun if they used it. We would have the good Avatar movie and the bad Avatar movie.

It seems that all "remakes" or new films suck on here (for a fair few) though.
Perhaps our expectations are too high? Is it really that bad ?
Fans and nonfans alike are ripping it apart. Its pretty rare movies get hazed this badly and universally. Its obviously pretty awful.
Even Transformers 2 people like the explosions and effects.
