I don't think this makes much sense, simply because there are a bunch of malfunctioning toys aside from Soldier-san. Are you suggesting that they all fled? Even though they were all "acting normal" until a sudden attack of "the human disease"? If this was a case of toys who fled, the scrapheap would be pointless. There's clearly a different and misterious way to null the contract.
I'm guessing it has to do either with the curfew or with the human homes. I mean, either something happens to the toys who didn't return, or something happens when they enter a human home. Maybe his own home. Maybe all Soldier-san did was go to the palace. Maybe he was already there. Maybe they allowed him, as a toy, to go there (under orders) because they had forgotten the palace used to be his home.
Doflamingo has reasons for the two laws he enforces, Soldier-san made that clear. And it's pretty much suggested that both laws are fundamental to the maintenance of his plans. So, for me, it maked more sense if at least one of these laws was made to keep Sugar's power working.
