I wouldn't say that. It's the same exact episode, so I don't really see the difference between distributing a self-subbed copy of a TV rip downloaded off the internet and an already subbed. You're still distributing material you don't have the right to in order to do people who don't have access to it a service, the only actual difference at hand here is that in this case the subtitles are professionally done.
Ripping and posting DVDs is looked down upon just like fansubbing a series that's already on DVD - you're no longer presenting the series to people who don't have access to it, just making it available for free. The series IS available for you to purchase, and you should support it by doing so.
The simulcast, however, is unavailable to most (and those it's available for don't actually pay for it), so there shouldn't be any problem there.
Fansubs were accepted before because there was no legal way of watching the series subtitled. If there WAS such a way, it wouldn't be as accepted, since people could just buy the DVDs and support the series. Well, there STILL isn't a way to legally watch the series subtitled, so fansubs would still be accepted, right? If so, what difference does it make whether the distributor writes, times and applies his/her own translation of the episode, or uses the one that's already available? The exact same legal toes are being stepped on, the only difference made is that the distributor doesn't have to waste hours on the actual translation work. It's not like it makes any ethical difference to the viewer whether this was translated by Joe Smith, professional translator or Bob Jones, random person with computer, and neither option supports Funi any more than the other. No matter what, you're still watching something they have the right to, but doesn't let you watch, free or otherwise.
Fansubs are about making foreign material available to those who couldn't otherwise watch it, it's not about presenting one's own personal translation of the episode itself.
Because FUNi and Toei get Paid when you watch the Episode on their website Via Ads.
If it's Uploaded to a torrent site, I'm just gonna say right now, Those outside the US won't be the ONLY ones DLing the Ep, the US fans will be too, so those US fans are getting the same exact thing they could get for free by going to the FUNi site and watching it, only this way Nobody gets paid.
The point of Fansubs is to watch a series not available in your country yet, so it's kindof like a Robin Hood Effort. You Rob from the rich by subbing to give to the poor, who are those who don't have the show yet.
Doing the same with the Simulcast enables people to get the Simulcast, with FUNi subs entirely for Free, as in FUNi doesn't even make any ad-money.
It's just my Two cents on the subject, and it's a Valid one. Isn't gonna change anything, it's just how I feel.
