Nope. Oda said in an SBS (volume 23, according to the One Piece Wikia) that her paint attacks were a form of hypnosis, not a Devil Fruit power or a DF power that belongs to her paint set.

And even if you do count that (even though it doesn't count) it's still pretty sad that those are the only instances, out of 10 hundred thousand chapters.
Plus if you go by that, then Nami is technically the only pirate. But then again, she didn't call herself one when she did that for a living.
Nami said she was just a "Pirate Thief" and would never be a pirate, back then. -
You read the romance dawn chapter(s) right? There (in one of them atleast) Luffy wanted to become a pirate that attacks other pirates instead of civilians. That pretty much carried over to One Piece.
And why doesn't booty stolen from other pirates count?

That's out of context. Nami considered herself a thief instead of a pirate and that stealing from pirates wasn't against the law since they were criminals. That doesn't make the act any less "pirate" and it is still stealing, just not in the eyes of the law.

The law defines what a pirate is. Or you could go by its actual definition.

In the one shot collection "wanted" (can be downloaded via KEFI or Null scanlation groups) there is a prequel to One Piece where Luffy explains to Anne (a Nami look-a-like) about 2 kinds of pirates. He says he is looking for Peace Mains to join their crew.
Anne:"Piece Main?"
Luffy: "It's a type of pirate."
"Pirate crews like this one who just pillage are called "Morganeers." Pirates who adventure by feeding on Morganeers are called "Peace Mains."
"I'm going to be a piece main".Obviously Odaverse definition of Piracy differs from Lobsterverse definition.
Or you could go by its actual definition.

I never said that he wasn't a criminal. I said that he doesn't "pirate" anything. Luffy IS a terrorist to the government and DOES brake laws. However he still personally doesn't pirate anything.
This whole thing was brought up because people were saying that Naruto isn't a ninja. Well he is in his world just as Luffy is classified as a pirate in his own.

The marines don't give a damn who Luffy steals from, he proclaims himself a pirate, has a ship, reasonable fighting power, crew members and is therefore a pirate that needs to be executed.

Neiji is a way better candidate for Hokage, and thats assuming Kakashi can't be persuaded.But, him having the beast also had the drawback that he couldn't control the finer points of his jutsu and could only use jutsu involving sheer force (sheer leeching off kyubi).
Without Kyubi, his dad Minato would've still been there to teach him majorly kickass moves, so I dunno. -

Doubt that for two reasons
1. Gaara usually liked to work alone
2. Naruto was not yet able to use or was aware of Kyuubi's chakra until
Haku & Jiraiya came along.
