Lucci is more overtly nasty, but even if Kaku doesn't ACT as bad, he's still going along with it, which makes them morally equivalent. One Piece is full of supporting villains who don't seem particularly vicious in themselves, but they cheerfully assist in the most horrible things - most of them end up having cover stories. Jango, Hacchan, Miss Goldenweek, etc.

Lucci strikes me as being cold and emotionless. Kaku doesn't. He may have done a horrible thing, but I just get the feeling that he actually does have some compassion in him. But who knows, maybe it'll turn out to be the opposite. XD

Rob Lucchi, by a country mile. Like it has been said many times before, Kaku still considers himself a serious shipwright, and even though it probably wasn't his place to interfere with Merry, Kaku 'the shipwright' probably felt he was doing a service to Merry & Usopp by attempting to sink or destroy her. (Remember we don't know if Merry has met her end, we only assume it.)
I truly believe there wasn't any real malice in Kaku's actions, though it seems overly harsh to us, it was probably intended for the best, maybe not for Usopp, but more for Going Merry the ship.
