I heard this story before on the Michael Regan show, and this was not illegal IF the animal enjoyed it, at least that is what the story reported. For some reason the proprieters of this …uhhh... "establishment" took videos of their clients "encounters". So the police are studying the videos to see whether or not... well you know.
Can you imagine being a married man who has to study these videos? He goes home to his wife and asks, "What did you do at work today honey?"
As to this particular case, the man had his colon destroyed, which meant that the horse was the dominant male. I don't think the horse was the one suffering.

Well, since "perforated colon" means the guy was GETTING, not GIVING, I can't imagine that the horse was having too many problems. If the stallion didn't mind mounting, that's his choice.
