Bit of a question, don't you think? Now, when people get married, isn't it a legal vow that shows how much you care for another person? How much you desire to be with them forever? Infidelity in marriage should, in my opinion, be classified as a crime because, in the process, a legal vow is being broken. If you're really that desperate to see someone else's sheets, shoot for a divorce.

But people who commit infidelity while married are still legally bound together. So, people really should get a legal divorce if they want to be with someone else that badly.

Aside from that punishing it by law.. maybe something like not allowing them to get married for a certain amount of time (5-10 years) would be appropriate, but not something more serious, no one would realistically go for it except for people that are deeply religious (granted there are a lot of them, but more importantly they don't control the major funders of campaigns).

No, it should not be punishable by law. If we made infidelity a legal matter, then why not make spending your spouse's money without their permission a crime? Or how about making it a crime for an angry spouse to throw their spouse out of the bedroom to sleep on the couch for a night? Oh hell, let's just have making any decision without the involvement of your spouse a crime. Better yet, let's make every single type of problem that can ever occur in this world a matter of law.
Let a couple take care of the problem by themselves. It's best for them.

No, because generally the pain and aggravation of dealing with infidelity is punishment enough in the long run. It's a personal matter that the law does not need to stick its nose into. Court systems in CA are bad enough with the "no fault" law in divorce.
I was just hearing a story from someone I know who's wife was having an affair with a coach at the school she worked at. She divorced her husband and married the other guy, and he turned out to be a controlling jerk.
She brought her own grief upon herself, what good would bringing an outside force of law do? -

That's actually a pretty good idea, in my opinion. It might teach the person to reconsider their actions involving their marriage and adultery. It could also be a more preferable option than something like jail time.

Is the OP married? Has the OP been cheated on or just what exactly is the motivation for this thread anyway? what made you think about adultery and ways to discurage it?
I saw a thread with just the same topic on another forum just before i registred at this one.
i think one argument was a texas vs lawrence or some other name that stated any laws about adultery would be unconstitutional or something. Since im not american i didnt really look in to it though.

The legal process that allows a cuckolded spouse to seek compensation from the cheating one should be enough. People do have different views on what their partners should and should not do, so that would make it hard for the court itself to decide if the cheater should be punished or not, and to what degree.
Matters of households and matters of the state should be as separated from one another as possible, imo.
