Coming to a City Near You: MTV Games, Harmonix and Electronic Arts Kickoff Nationwide Tour
Fans Play for Opportunity to Rock On-Air in MTV's "Battle of the Bands"
New York, NY - September 6, 2007 - Harmonix, the leading developer of music-based games, and MTV Games, a division of Viacom's MTV Networks (NYSE: VIA, VIA.B), along with distribution partner Electronic Arts (NASDAQ: ERTS), announced today that Rock Band is hitting the road on a coast-to-coast tour to give consumers the chance to try the award winning game everyone is talking about before it comes out. In addition, budding musicians can choose to participate in a "Rock Off" audition for an opportunity to appear on MTV's TRL. Two selected bands will participate in a live "Battle of the Bands," with the top group being asked to open for one of rock's biggest bands at the Rock Band launch concert this Holiday 2007.
"We're a couple months away from the launch of Rock Band and the response has already been incredible," said Jeff Yapp, EVP, MTV Program Enterprises. "We simply couldn't wait any longer to get the game into consumers' hands and give them a taste of the power of the Rock Band experience. This tour will give everyone from casual music fans, to hard core gamers and professional musicians the chance to live out their rock star fantasies on an authentic concert stage and the chance to audition for a once in a lifetime opportunity to fulfill their rock star fantasies live on MTV in front of thousands of fans."
Kicking off on Sunday, September 9th in Las Vegas, NV during the "2007 MTV Video Music Awards" Weekend, Rock Band outfitted tour rigs will spread across the country on a 24 city tour - from California to Cleveland, Atlanta to Arizona and everywhere in between - to give music fans the chance to play on a full concert style stage with all of the lights and monster sound systems they're used to seeing at a classic arena rock concert. Whether consumers are instrument experts or gear rookies, everyone will get a chance to rock with Rock Band.
And it doesn't stop there. Aspiring rockers will have the chance to participate in a nationwide casting call through MTV's Rock Band "Rock Off" events. All performers brave enough to play on the Rock Band tour bus main-stage will be captured on video and viewed by MTV casting directors. Two bands will be chosen and flown to New York City to spend a day with a real rock band and receive true rock star training. The auditions will culminate with the bands rocking on-air on MTV's TRL, and one band ultimately chosen to open on a real stage for a yet-to-be-named mega band at the Rock Band launch concert.

Terms and Conditions of Participation in MTV’s Rock Band 2007 Tour Auditions
MTV’s Rock Band 2007 Tour Overview: The Rock Band mobile tour is a mobile tour produced by MTV Networks, a division of Viacom International Inc. (“MTVN”) that will travel to various states throughout the country during the period of approximately September 12, 2007 through November 4, 2007 (“Mobile Tour” or “Mobile Tours”). The Mobile Tour will give Rock Band fans a chance to get their hands on the new Rock Band product and audition for a chance to participate in a Rock Band challenge on MTVN’s program TRL with the winning band performing on Rock Band as the opening act at the Rock Band Launch Concert (“Opening Act Band”), currently contemplated to take place in California on or around November 19, 2007.
Eligibility: You must be a legal resident of the 50 United States and be at least 18 years of age to participate in Auditions (as hereinafter defined). If 18 is not the age of majority in the jurisdiction, in which you reside, you must obtain parental or legal guardian consent to be eligible to participate in Auditions. You cannot participate in an Audition if you are, or have an immediate family member, [parent, spouse, children, siblings, step-children and step siblings] employed by MTV Networks, a division of Viacom International Inc. (“MTVN”), or its affiliated companies, sponsors, subsidiaries and advertising agencies.
Rock Off Auditions: MTV’s Rock Band 2007 Tour Rock Off Auditions are a series of onsite auditions at the Mobile Tour Locations (as herein defined) (“Audition” or “Auditions”). During the Mobile Tours aspiring Rock Band fans will have the opportunity to form bands and practice in the designated demo areas located near the traveling Rock Band trucks that will be stationed at the Mobile Tour Locations and get their bands ready for the Auditions that will take place on the main stages attached to the trucks (“Rigs”). Each Rig will be equipped with a full concert style stage with lights, monitors, monitor sound and approximately 4 to 5 Rock Band gameplay stations. In addition, trained demo teams will present and play the Rock Band product and will be available to teach participants how to play.
Rock Off Auditions: Mobile Tours commence on September 12, 2007 and end on November 4, 2007, (“Audition Periods”). Mobile Tour dates and locations as presently contemplated to take place as follows, but are subject to change in MTVN’s sole discretion, (“Mobil Tour Locations”). Updated Mobile Tour Locations and hours of operation will be posted on this site on a periodic basis. Review this web site for updates prior to attending Mobile Tours.

NOTE: The above schedule represents the Audition Periods. Mobile Tour will continue to travel to various states in the United States beyond the Audition Period through December 2007.
To Audition: Visit one of the Mobile Tour Locations during the specified hours of operation and establish a four (4) member team, (“Band”). In order to participate in Audition, the Band must consist of four (4) participants, and one participating Band member must be designated as the main contact (“Leader”). Participation will be on a first come first served basis. Each Band member must obtain, complete and submit the Audition Eligibility Form, MTVN guest/performance release and any other documents that MTVN may deem necessary. Each Band member must also agree to the terms of MTVN’s Privacy Policy which will be available at Mobile Tour Locations.
Bands will then select one (1) song to perform at this Audition from a list of songs provided by MTVN. Audition performances will be judged by producers and employees of MTVN (“Judges”) based on the judging criteria specified herein.
MTVN assumes no responsibility for any internal disputes among members of Bands. Such disputes will not be resolved by MTVN. In the event that any dispute interferes with the operation of any of the Audition processes, Band, including each Band member, may be disqualified in MTVN’s sole discretion.
Judging Criteria: The Judges are looking for individuals that can demonstrate Rock Band game play proficiency and accuracy, radiate energy, vitality, possess stage presence and are comfortable in front of a camera. The final determination of the finalist Bands (“Finalist Band” or “Finalist Bands”) and the Opening Act Band and the application of the judging criteria shall be in the sole and absolute discretion of the Judges. The Judges reserve the right to extend the Audition Periods or not to declare any Finalist Bands or any Opening Act Band, if, in their sole discretion, the Rock Band game play performances do not meet the minimum qualification standards based on the judging criteria specified herein
MTVN Produced Video Material: All Band practice and Audition performances on Rigs, or any other participation and/or performance by any Finalist Bands and Opening Act Band will be video taped by MTVN (the “Video Material”) and each participant, as a condition of participating in Audition, and any other Finalist Band or Opening Act Band event, must sign (or if a minor in the jurisdiction in which they reside, their parent/legal guardian must sign) the MTVN guest/performance release in order to enter Rigs and again prior to any other Finalist Band or Opening Act Band participatory events.
MTVN shall be the exclusive owner of the copyright and other rights in and to the Video Material and MTVN, its subsidiaries, affiliates, affiliated broadcast stations and networks and licensees will be able to use the Video Material forever and throughout the world, and to license others to use it, in any manner MTVN wishes and in any and all media now known or hereafter discovered or developed without notice, including for advertising, promoting and publicizing any of their products or services, such use may include portions and excerpts, in addition to cut-in, synchronized, dubbed and superimposed versions of the Video Materials. By participation in any of the Audition events, entrants acknowledge that MTVN may use the Video Material in accordance with the permission granted herein without any compensation, royalty, payment, liability or obligation to any entrant or any third party. MTVN is under no obligation to broadcast or otherwise exploit the Video Material.
Finalist Band Notification: On or about November 4, 2007, the Judges will select the two (2) Finalist Bands. MTVN will make up to three (3) attempts over the 48 hour period following Finalist Band selection to contact the potential Finalist Bands by calling the Leader of the Finalist Band via the telephone number(s) provided on his/her Audition Eligibility Form. If a Leader cannot be reached during the 48 hour period in which he/she is called, the potential Finalist Band will be disqualified and, an alternative Finalist Band may be selected from the remaining participants in MTVN’s sole discretion. In addition, MTVN reserves the right to select an alternative Finalist Band in the event that any potential Finalist Band fails to comply with these Terms and Conditions.
Finalist Band Verification: Each member of the potential Finalist Band must prove eligibility, including, without limitation, proof of age and residence within three (3) days of being notified as a potential Finalist Band. In the event of non-compliance by any member of the Finalist Band, such Finalist Band shall be disqualified and all privileges otherwise due as a Finalist Band shall be terminated and an alternative potential Finalist Band may be chosen from among the remaining participants in MTVN’s sole discretion. Each member of a Finalist Band must sign (or, if 18 is not the age of majority in the jurisdiction in which he/she resides, his/her parent or legal guardian must sign) within three (3) days of receipt of such documents from MTVN: (a) an affidavit of eligibility and release of MTVN and its officers, directors, employees, agents, members, affiliated companies and subsidiaries, from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with participation in these Auditions and associated events; (b) except where prohibited by law, a promotional release granting MTVN the right to use their name and likeness for advertising and publicity purposes without additional compensation; and 
any other guest/performance release or other legal document deemed necessary by MTVN and return them as instructed within the time frame specified by MTVN or Finalist Band may be disqualified at MTVN’s sole discretion. Each member of the Finalist Band also must acknowledge that MTVN has not and will not obtain or provide insurance of any kind to any member of the Finalist Band relating to Finalists Band’s participation in any trips or events associated with this MTV’s Rock Band 2007 Tour Auditions and that each member of Finalist Band will be responsible for obtaining and paying for any form of insurance.
Rock Band Training Trip: The two Finalist Bands may, in MTVN’s sole discretion, get the opportunity for MTVN to arrange for them to spend one day with an established band. MTVN would provide transportation, which may include round trip coach class air transportation for each Band member and two (2) nights hotel accommodations, depending on location of event, (“Rock Band Training Trip”)
TRL Trip: The two Finalist Bands will get the opportunity to come to New York and perform one (1) MTVN provided song in a head to head Rock Band challenge on a live broadcast of TRL in New York, NY to be judged by Judges, currently contemplated to take place on November 12, 2007, but subject to change in MTVN’s sole discretion, wherein the winning Band will be declared the Opening Act Band live on TRL. The trip will include: (i) round trip coach class air transportation for each member of the Finalist Band which shall originate from an airport of MTVN’s choice nearest each Finalist Band member’s residence (as determined by MTVN) to New York, NY. MTVN reserves the right to substitute ground transportation for air transportation for any Finalist Band member that resides within 150 miles of New York, NY; (ii) two (2) nights hotel accommodations in New York, NY for each member of the Finalist Band (meals, telephone calls and other incidentals and costs are not included); and (iii) roundtrip ground transportation between airport and hotel in New York, NY, (the “TRL Trip”). If for any Finalist Band member, 18 is not the age of majority in the jurisdiction in which they reside, that Finalist Band member must be accompanied by his/her parent/legal guardian and such person must pay his/her own expenses. Rock Band Training Trip and the TRL Trip will collectively be referred to as (the “Trips”).
Opening Act Band Trip: The Opening Act Band will get the opportunity to go to a destination to be determined, in MTVN’s sole discretion, in California (“Destination”), currently contemplated to take place on November 19, 2007 but subject to change in MTVN’s sole discretion. The trip will include: (i) round trip coach class air transportation for each member of the Opening Act Band which shall originate from an airport of MTVN’s choice nearest each Opening Act Band’s residence (as determined by MTVN) to Destination. MTVN reserves the right to substitute ground transportation for air transportation for any Opening Act Band member that resides within 150 miles of Destination; (ii) two (2) nights hotel accommodations in Destination for each member of the Opening Act Band (meals, telephone calls and other incidentals and costs are not included); and (iii) roundtrip ground transportation between airport and hotel in Destination, (the “Opening Act Band Trip”). If 18 is not the age of majority in the jurisdiction in which any Opening Act Band member resides, that Opening Act Band member must be accompanied by his/her parent/legal guardian and such person must pay his/her own expenses.
General Trip Terms: If any member of a Finalist Band or Opening Act Band is not available to travel on the dates specified by MTVN in its sole discretion, Finalist Band or Opening Act Band privileges for the entire Band will be terminated and an alternative band may be selected from the remaining applicable participants. MTVN will determine the airlines and hotels in its sole discretion. Travel restrictions, conditions and limitations may apply. Band members must each possess valid travel documents in order to travel. Travel arrangements are subject to availability and must be roundtrip. MTVN shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. MTVN shall not be liable for any loss or damage to baggage. The dates for travel for the Rock Band Training Trip will be on or around November 5, 2007, the dates for fulfillment for the TRL Trip will be November 12, 2007, and the dates for fulfillment for the Opening Act Band Trip November 19, 2007, and all are subject to programming requirements and such dates are subject to change in MTVN’s sole discretion. In addition, MTVN may delay, cancelled or postpone the Trips and Opening Act Band Trip in its sole discretion. All costs and expenses not specifically listed above are Band member’s sole responsibility.
General Terms: Noncompliance with any of these Terms and Conditions may result in disqualification. ANY VIOLATION OF THESE TERMS AND CONDITIONS BY A PARTICIPANT OR ANY BEHAVIOR BY A PARTICIPANT THAT WILL BRING SUCH PARTICIPANT OR MTVN INTO DISREPUTE (IN MTVN’S SOLE DISCRETION) WILL RESULT IN SUCH PARTICIPANT’S DISQUALIFICATION FROM THE MTV’S ROCK BAND 2007 TOUR AUDITIONS.
MTVN assumes no responsibility for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in these Auditions or by any human error which may occur in the processing of the entries in these Auditions. MTVN is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials relating to these Auditions.
