Basically, it's like Yasopp said in that one filler. Pirates don't have to kill [or plunder] if they don't feel like it.
Seriously, historic pirates weren't all Jack Sparrows and Will Turners. Their basic plan of attack was to sail up to a merchant ship in an overcrowded dinghy slightly bigger than that thing Luffy first set off in as loudly as possible then jump in and start killin'. After the robbing, killing and ransoming was done for the day, they'd move into the nearest port where, instead of stereotypically burying their hard-earned dough, they'd blow it all on booze and hookers.
This cycle usually continued until the pirate in question was either caught, shot down or died of Syphilis.
So, yeah, I tend to prefer Luffy's romantic ideals of piracy.
Aceburner is quite correct but pretty much everyone here forgot something just as important.
A pirate, both past and present (when it comes to piracy), are people better considered as outlaws that break away from normal society and initially refuse to conform to government law and proceedings. The second part of the definition is that stealing is involved. The SH fail in the second part for some cases but the fact that the goal is to take OP (which is supposed to be a grand treasure of the world) kind of keeps it semi-true to that portion since they beat the snot out of the competition so in that sense they are stealing and ruining the oppurtunity for others.
Usually captains and their crew are kept together in the sense of an agreement. This agreement for crew members is usually a cut in profits and other such things with punishments understood for breaking common law of the ship. If the captain fails to uphold this you get such things as mutiny.
Also the "walk the plank" bull$#!% is all hollywood, only one case of this was ever known to be done in european piracy.

4. Destruction of Public Property: Temple in Alubarna, Streets of Alubarna (Though All the Strawhats are guilty of this, except Usopp and Chopper)

Wapol himself had already declared himself to be a pirate. Don't think he counts. Also Aokiji? Probably didn't report that he could have killed Luffy but let him go…
Pirates in One Piece are basically freeroamers who don't observe laws, boundaries, and live on the sea.

Naruto is as much as a ninja as Luffy is a pirate. They both are considered pirates/ninjas in their worlds. But that's about it.

I think i agree with skarlath. I mean, Luffy doesn't really count as a pirate if he doesn't plunder from others. So, the only time when they were truly being pirates were when Nami stole her own country-men's wallets and they robbed the gold from the the big snake's mouth in Skypiea, technically.
Fighting the marines and charging into Enies Lobby doesn't really make them pirates; it just brands them as outlaws.

I think this is the intention of the author, Eiichiro Oda. Oda wants his readers to realise that the One Piece world, while seemingly fun to live in, really is screwed up in its own way. The World Government, trying to maintain its grip over the world, accuses anyone of going against them as being "pirates" (with perhaps the exception of the Revolutionaries, but, being called such, the WG has no reason to call them other than what they already are). That is, anyone who hangs up the Jolly Roger is accused of being enemies of the WG.
From Luffy's perspective, this is considered fortunate for him since being labeled as a pirate is what he wants and his escalating bounty is like an indication of a step closer to him becoming the Pirate King. So, it doesn't really matter whether they technically are pirates or not; as long as in the One Piece world, everyone recognises them as being pirates, be it the WG or civilians, then in hindsight they already are pirates. After all, piracy is a term defined by society, and so if society recognises you as such, then you are such.
I hope I made any sense in what i just said.

Technically he has plundered a lot, just from other Pirates mostly. And People have their own definition of Pirate. Shanks is a perfect example, his short one-liners about what it means to be a Pirate that he said to Buggy reflect this.
EDIT: And on the topic of Naruto's Ninja's, Shino and Shikamaru are SO DEFINATLY Ninja's. More so than like, ANYONE ELSE in that entire series.
A pirate by its original definition and fictional counterpart are different. That's like saying cowboys in cowboy fiction all raise cattle, that's not true.
Besides, I always thought that was the irony of Luffy's situation: he's "playing pirate" in a world of "real pirates"– the definition he took to the seas with was the fictional one as opposed to the real one.
Its Shonen people, OP would not be popular if the SH were going from town to town destorying shit, raping people, ect.. But I will say the SH are more Pirates than Naruto Ninjas are Ninjas. You want real Pirates watch Pirates of the Caribbean.

This thread is complaining that the Sh are not Pirate enough, i'm just pointing out that Naruto Ninjas are also not Ninja enough. Its just Shonen people.

In any case, I'm with you skarlath. It would be great to see Luffy and Co. actually act like pirates at some point.
Right now, however there is an over abundance of Pirates traveling the seas, especially in the Grand Line. This means that there is a scarcity of trade between islands because any trade ship is likely to be attacked by Pirates. The ramifications of this can be seen in the Franky flashback in which W7 was dying from lack of trade until the sea train was built.
So, because there are so many pirates and so little trade, most of the easily accessible gold in the One Piece world should be in the hands of those who can protect their wealth. This means that the richest targets for a Pirate are going to be extremely well guarded by either Marines or Pirates.
When looked at in this manner, the strawhats are quite successful Pirates. They have attacked other Pirates and gotten away with their treasure on several occasions (Buggy, Kuro, and now Moria) and have also raided Marine outposts like Morgan's, EL, and the Puffing Tom.
In their one opportunity to raid a rich civilian settlement, in Skypiea, they did so. Admittedly, they didn't want to hurt anyone and could have just asked, but they preferred to steal it and run away like good Pirates. They really haven't had much opportunity to raid any of the other settlements they have run across. Drum had already been ransacked by Blackbeard, Alubasta was led by a member of their crew, and all of the other towns they have been to have been piss poor with nothing to rob.
So, they are still Pirates. I'm willing to bet that we will eventually hear about Shanks and Whitebeard, among others, ransacking towns, robbing rich convoys, etc. And Blackbeard has already done this on numerous occasions. Pirates are still crimnals in the One Piece world, even the nice ones.
Let us change view points.
I am the world government, and I believe this to be a list of your offenses.
1. Association to Red Hair Shanks. Shanks is considered one of the four most dangerous pirates on the Grand Line. Strawhat Luffy is seen as a disciple to a yonkou, and just be association alone, is a wanted man for more information on Red Hair.
2. The Strawhats are flying a pirate flag. Anywhere they go, fear would most likely be the first reaction.
3. Strawhat Luffy infiltrated and disrupted a marine base (Morgan); he also played a key role in the escape of a prisoner (Roronoa Zoro.)
4. Roronoa Zoro, an escaped criminal, resides on the Strawhats ship.
5. Strawhat Luffy defeated the strongest criminals in East Blue, an obvious attempt to seize control of a sea. There could be possibly no other motive.
6. The Strawhats had the power to enter the Grand Line, and the audacity to fly a Pirate flag; a direct knock at the world government.
7. They supported a rebellion (Drum Island) and helped the rebels thwart a King from reclaiming a kingdom that was part of the World Government.
8. Commodore Smoker has confirmed that Monkey D. Luffy is the brother to Portugas D. Ace, captain of the second division of the White Beard Pirates, another Yonkou.
8. They beat down Shichibukai Pirate, Crocodile. This confirmed their strength and showed their defiance at the World Government.
9. They acquired Nico Robin, a devil that received a 79 million beri bounty at the age of 8. Nico Robin is wanted for illegal activity and possessing the power to restore a power great enough to topple the balance of the entire world.
10. They attacked and destroyed Enies Lobbies, and in the process, defeated Cipher Pol 9, one that was widely accepted as the strongest CP9 ever; headed by Rob Lucchi. Furthermore, they survived the Buster Call, a national level power.
11. Recent information has revealed that Strawhat Luffy is the son to the world's most wanted man: Dragon. Furthermore, Luffy's grand father is Marine Vice Admiral Monkey D. Garp. The lineage of the family is obviously abnormal.
That is a good summary of why the Strawhats are criminals. ;) I'll edit this a bit later, time to go.
Great post Mister_Anbu. Don´t forget the declaration of war at Enies Lobby. That is a move of its own already that can be seperated from the Enies Lobby attack. Otherwise nobody would have made a big fuzz about it since the invasion was already going in full swing.

you know even if Luffy and such aren't real pirates (which I think they are) they're the ones with huge bounties. I mean the most feared pirates are the ones like Luffy's pirates (Shanks, Whitebeard, the other 2 emperors) so if you ask me, that makes them better pirates then the ones who plunder and pillage weaker people.

Plus One Piece is not about pirates, but more about the romantic sense of Adventures.
Really, if you want to see outcasts of society that act like what they are, there's plenty of stuff out there for your particular taste.
Pirates are those who live free from the rules of society. Other then that, they do what they want. They don't have to be complete asses to prove they're pirates. Also, the strawhats do enough pirate things anyways. All they're missing are just the negatives of a stereotypical pirate.

They are free-wandering souls who just want to live their lives, accomplish their dreams and be free from society's chains. The Strawhats are true pirates for living their dreams. I think one of the best examplse of how Luffy is a real pirate is when he first met Coby and he told him how he wanted to be the Pirate King and how he didn't care about dying.
